Terms of Service

These terms govern your use of MARKER, a skills-assessment platform operated by Belkirk Group Pty Ltd (ABN 31 646 321 164). By registering or using the service, you agree to them.
1. The service
MARKER provides online skills assessments (typing, Microsoft 365, Revit, Estate Master and related modules) and reports of candidate results. We may change or discontinue features at any time.
2. Accounts & eligibility
You must be authorised to act on behalf of any company you register, and you may only invite candidates with a legitimate basis to assess them. You are responsible for keeping your login secure.
3. Credits & billing
MARKER uses a credit-based model — there is no subscription. Every account includes 3 free candidate assessments. After that, you buy credit packs as you need them: 1 credit for $39 + GST, 10 credits for $249 + GST, or 25 credits for $499 + GST. The MARKER Certified badge is an optional one-off purchase of $11 + GST per eligible candidate. All payments are processed by Stripe. Credits you purchase do not expire. Refunds are issued at our discretion for unused credits in the case of a verified platform error — contact us if you believe you are entitled to one.
4. Acceptable use
You agree not to misuse the service, attempt to circumvent assessment integrity controls, or use results in a way that misrepresents a candidate. We may suspend access for breach of these terms.
5. No warranty
The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that assessment results are error-free, complete, or a definitive measure of a candidate's ability.
6. Limitation of liability
To the maximum extent permitted by law, Belkirk Group Pty Ltd, its operators and affiliates are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, business opportunities or goodwill, arising out of or in connection with your use of (or inability to use) the service or any reliance on assessment results — whether in contract, tort (including negligence) or otherwise — even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of these terms is limited to the amount you have paid us in the 12 months preceding the claim.
7. Indemnity
You agree to indemnify Belkirk Group Pty Ltd against any claim or loss arising from your use of the service, your breach of these terms, or your use of candidate results.
8. Changes & governing law
We may update these terms from time to time; continued use after changes constitutes acceptance. These terms are governed by the laws of Victoria, Australia.
